Senate Bill 12: Health-Related and Health-Care Services

Parental Rights Handbook  Parental Rights and Options Information

Katy ISD offers a range of health-related and health-care services to promote the physical, social, and emotional well-being of its students. Under Texas Senate Bill 12 (SB 12) and Texas Education Code §26.0083, parents and guardians have the right to withhold consent for one or more of these services, except in cases of general care taking, life-threatening emergencies, or crisis situations that require immediate intervention.

General caretaking is routine support provided to students during the school day. It is not a health-related service or a health-care service and does not require parent consent under Texas Education Code §26.0083(m). General caretaking includes:

  • Asking about daily or general well-being; checking on a student who reports feeling unwell

  • Helping calm an upset or crying student or de-escalating a student

  • Providing a change of clothing when appropriate or temporary support while contacting a parent

  • Cleaning minor cuts, scrapes, spills, or accidents; applying adhesive bandages; assisting with a bloody nose

Services Available to Students

The following services are available through Katy ISD. Parent consent requirements depend on the type of service.

Some school counseling services are considered health-related and parents may withhold consent under Texas Education Code §26.0083, including individual or small-group counseling focused on stress management, grief support, emotional regulation, or similar health-related concerns. Other counseling activities are part of the District’s comprehensive school counseling program required under Texas Education Code §33.006 and include services related to students’ academic, career, personal, and social development. These programmatic services include academic and career planning, classroom guidance activities, character education, healthy relationships instruction, and bullying prevention, and are provided as part of the student’s educational experience.
